The parental leave checker helps cross-border workers understand their entitlements under both Swiss and Italian law. Switzerland provides 14 weeks of maternity leave at 80% salary (APG/EO insurance) and 2 weeks of paternity leave introduced in 2021 under the same conditions.

Italy offers additional protections: 5 months of mandatory maternity leave paid by INPS at 80%, and optional parental leave of up to 11 months per family. For optional leave, the benefit is 30% of salary for up to 6 months, with an additional month at 80% introduced by the 2024 Budget Law.

For cross-border workers, the coordination between Swiss and Italian social security systems determines which country pays the benefit. If employed in Switzerland and residing in Italy, Swiss APG covers the mandatory maternity and paternity period, while additional Italian parental leave may be available through INPS under bilateral coordination rules.

The tool calculates the financial impact of each leave option on your Swiss payslip and Italian tax return. During Swiss maternity leave, APG benefits are subject to AVS/AI/APG contributions but exempt from withholding tax. Upon return, salary resumes in full with no contractual penalty.

The checker clarifies deadlines: notification to the Swiss employer must be at least 3 months before the expected delivery date, the APG claim must be filed within 5 years, and the Italian parental leave application to INPS requires form SR23 with details of the foreign employment.
